ARTICLE 1: ORGANISING COMPANY AND GAME PRESENTATION
The company 3nko whose head office is located at 5, rue de la chagnée
17170 Ferrières d'Aunis, in France (hereinafter referred to as the "Organising Company")
distributes the simulation game called "Funnypigs" (hereinafter referred to as the "Game")
which is accessible on the website whose Internet addresses are www.kochonland.com
and www.kochonland.be and on any partner sites authorized by 3nko.
ARTICLE 2: ACCEPTANCE
Participation in the Game implies acceptance of the present Charter and the Game rules
in full and without reservation. Anyone in breach of any of these terms and conditions
will be denied participation in the Game.
ARTICLE 3: PARTICIPATION
This game is open to anyone in any country and is not age restricted.
ARTICLE 4: MINIMUM REQUIREMENTS
Before taking part and in order to ensure the smooth running
of the Game, players are advised to see
that their computer meets the minimum system requirements
and has one of the following Internet browser installed:
Internet Explorer 6.x or higher, Opera or Firefox.
MANDATORY REQUIREMENTS
Players must have Java and Javascript enabled and Flash installed
and must have set their browser to accept cookies.
ARTICLE 5: GAME TERMS AND RULES
The Game was put online on October 21st 2002. It is accessible
from 4am to 1am GMT the following day on the website whose Internet addresses
are www.kochonland.com and www.kochonland.be as well as on any partner sites
authorized by 3nko to distribute the Game.
5.1 Game Rules
Funnypigs is a pig breeding simulation game which covers all aspects of the pig industry.
The Game is free. No purchase necessary.
To register, players must fill in all the mandatory fields of the registration form.
They will choose freely their login details (username, screen name and password)
granting them access to the Game. Once registered, players may modify
their personal data and ask to be reminded of their password should they forget it.
For a fair and valid game, players must strictly comply with the registration terms
set out on the website whose Internet addresses are www.kochonland.com and www.kochonland.be
as well as on any partner sites authorized by 3nko; and with any other guidelines imparted
to them by any other means.
Users agree not to choose a screen name and/or a pig name that infringes the rights
of any third party or that is deliberately confusing, offensive, racist, anti-Jewish,
obscene, defamatory or otherwise unlawful.
5-2 Terms of the Game
Users must be registered in order to play. The virtual currency
is named "the Keko". The game has 5 different levels. The aim is to get
to the next level up by completing an assignment (or several) set for each level
(see the game rules on the homepage).
To begin the Game, players start out at Level 1. Their account
is credited with 110 free Kekos. Players may buy more Kekos
with a variety of payment methods put at their disposal.
If a problem arises while purchasing Kekos or subscribing to SMS services
due to the players' own fault (wrong code entered, etc.), they will not be entitled to a refund.
ARTICLE 6: CHARTER AMENDMENTS
Should the need arise, the representatives of the Organising Company reserve the right
to amend any part of the present Charter and to take any decisions deemed necessary
for the implementation and interpretation of the Charter, provided players are notified.
Any amendment to the present Charter, significant or not, may be made while the Game is running.
Players will be notified and their continued use of the Game will be deemed as acceptance
of these amendments as appendices to the present Charter.
ARTICLE 7: LIABILITY AND LIMITATIONS
It is reminded that participation in the Game implies full acceptance
of the present Charter. Players authorize the Organising Company
to use and display their surname, firstname and username in the ranking charts
and in the internal communication facilities of the Game (Café, Forum, Funny-mail...).
By participating in the Game, players authorize the Organising Company
to use their screen name and the information regarding their location (city, Département, country...)
for any promotional purposes on the Organising Company's website
and on any related site or material without any form of compensation.
Participation implies knowledge and acceptance of both the characteristics
and the limits of the Internet, especially with regard to technical performance,
response times when consulting, querying or transferring information, risks of service disruption
and more generally speaking, the risks related to any Internet connection and transmission,
the lack of protection against possible hacking of data and the risks of being contaminated
by viruses circulating on the network.
The Organising Company cannot be held responsible for any malfunctions of the website(s)
and/or the Game experienced with a specific browser. The Organising Company cannot guarantee
permanent access to the website(s) and/or to the Game or that they're free from technical errors
or that the problems will be fixed. In case of a technical malfunction of the Game,
the Organising Company reserves the right to invalidate and/or cancel the game session
during which the malfunction occurred. There shall be no claims based on this.
The Organising Company cannot be held responsible if the registration data of a participant
are not received for a reason outside its control (such as a connection problem at the player's end,
a temporary server downtime, etc.) or are illegible or impossible to process (for instance,
if the hardware or software is not suited for the user's registration, etc.).
The Organising Company cannot be held responsible for any shortcomings
of the live communication service. This service doesn't affect how the Game works.
Any failure would therefore not penalize the participants in any way.
The Organising Company cannot be held responsible for any loss or damage
of any kind (personal, physical, material, financial or otherwise)
suffered in relation to the use of this service.
ARTICLE 8: PARTICIPATION IN LIVE COMMUNICATION (CHAT, CAFE AND FORUM)
You are solely responsible for any content transmitted
through the live communication facilities. You agree not to choose a username or/and a pig name
that infringes the rights of any third party or that is deliberately confusing,
offensive, racist, anti-Jewish, obscene, defamatory or otherwise unlawful.
You are solely responsible for any direct or indirect consequences
caused by disclosing any type of information - especially personal
and/or confidential - on you or a third party while using the live
communication facilities. You acknowledge that the Organising Company
can by no means be held responsible for the disclosure or its consequences.
You therefore agree not to hold the Organising Company responsible
for any content, information or service it might make available through
its live communication facilities. You are and remain solely responsible
for any direct or indirect physical or material loss or damage
in relation to the use of these facilities.
Any dispute arising between you and a third party shall be settled between
the two parties involved. Should the Organising Company be deemed responsible
by a legal authority, you nonetheless commit yourself to answer to any claim.
Without limiting the foregoing, you agree not to use this website to:
- send, submit, transmit any content that is infringing, libelous,
defamatory, obscene, harassing, hateful, racist, abusive, offensive
or otherwise violates any law or right of any third party;
- transmit any content that may constitute, without limitation,
an instigation to commit crimes or misdemeanour; an incitement
to hatred or violence for racial, ethnic or national reasons;
false reports; damage to the authority of justice;
information related to adoption, law proceedings, the suicide of minors,
an individual's financial situation, or the results of polls/surveys
that are subject to specific terms of use; defamation or slander;
invasion of privacy; or actions endangering minors, in particular
writing and transmitting messages of a violent or pornographic nature
or violating human dignity;
- transmit any content that you are legally bound not to disclose,
especially content protected by a law or a contract (including
without limitation internal, preferential, confidential information
learned or disclosed while employed or under a confidentiality agreement);
- disrupt the normal flow of communication,
change the speed at which the content is displayed on screen
so that other users are no longer able to follow the communication
or type their message; or engage in any activity that could disrupt
the users' abilities to communicate in real time with the live communication facilities;
- harass any other user in any way;
- give information asking users to visit other sites
(by creating hypertext links or just by supplying basic information)
with a content that may infringe on any applicable law or regulation
or on the rights of individuals or goods, and/or the rights of intellectual property;
- make any comment that could harm the Organising Company,
its reputation and image, and the Game itself;
- post or spread rumours;
- use the live communication facilities for trading purposes
or more generally to offer products or services
with the aim of making money directly or indirectly.
In case of any failure to abide by these rules and practices,
the Organising Company reserves the right to exclude the offender
from the Game at any time and without warning.
ARTICLE 9: DATA AND PRIVACY - IT, DATA AND PRIVACY LAW
In compliance with the law n° 78-17 of January 6, 1978
on information technology, data and privacy policy,
registered users have the right to oppose (art. 26),
to access (art. 34 to 38) and to rectify or remove (art. 36)
their personal data. To exercise these rights users can go
to their "Account" page during the site's opening hours.
Players are informed that keeping personal data is necessary
to register their participation. Wanadoo owns the database
containing all the personal information collected as part of the Game.
However and subject to the rights granted to anyone or/and any entity,
in application of the law of January 6, 1978, Wanadoo authorizes 3nko
to use players' personal data for the whole duration of the Game.
ARTICLE 10: ORGANISERS' DECISIONS
The Organising Company reserves the right to deny access
to the Game to anyone disrupting it in any way. It reserves the right
to sue anyone who cheats, defrauds, falsifies or disrupts in any way
the service described in the present Charter or attempts to do it.
It also reserves the right to amend all or part of the present Charter
or of the Game rules without notice.
The Organising Company cannot be held responsible for any loss or damage
of any kind (personal, physical, material, financial or otherwise)
suffered in relation to the use of the Game. The Organising Company
reserves the right to shorten, lengthen the duration of, or cancel
all or part of the Game should the need arise.
The Organising Company will under no circumstance be liable for
any consequences arising from these changes. However users may be
notified of these changes in advance via any appropriate communication
means, such as the Organising Company's website. It reserves the right
to momentarily suspend participation in the game should it,
or a potential hosting provider, no longer be able to guarantee
the continuity of service needed for the Game to operate normally.
In any circumstance beyond the control of the Organising Company
including, but not limited to, force majeure, acts of God, hacking,
strike, lock-out, fire, flood or threats to the financial and technical
integrity of the Game, the Organising Company may at any time cease
running all or part of the Game, even if its liability is not excluded
(provided it acted in good faith). Should the present Game be cancelled
in case of force majeure, users or winners will have no claim to compensation.
ARTICLE 11: JURISDICTION
The present Charter is subject to French law.
Should any dispute arise from its implementation or its interpretation,
the litigation will be submitted to the competent jurisdictions in La Rochelle,
unless an amicable agreement is reached.
